MacroSolve (PK: MCVE) Sues Hyatt for Patent InfringementTallahassee, FL 2/9/12 (StreetBeat) -- Mobile technology provider, MacroSolve, Inc. (Pink Sheets:MCVE), who brands itself in the app world through the name “Illume Mobile,” has filed a patent infringement lawsuit against Hyatt Corporation (NYSE:H) alleging a violation of MacroSolve’s U.S. Patent No. 7,822,816, which was issued to MacroSolve on October 26, 2010 by the United States Patent and Trademark Office. The suit is one in a number of patent infringement cases that the company has filed against household names such as Wal-Mart (NYSE:WMT), Facebook, Hertz (NYSE:HTZ), Priceline.com (NASDAQ:PCLN) and Southwest Airlines (NYSE:LUB), as well as seven other major companies in the travel industry claiming illegal usage of MacroSolve’s mobile app platforms.

"We've already reached settlement agreements with a number of companies that were in violation of our intellectual property rights and we believe we will continue to find amicable ways to receive compensation for the use our inventions," said MacroSolve Vice Chairman, Jim McGill, in a press release today.
The patent addresses mobile information collection systems across all wireless networks, smartphones, tablets, and rugged mobile devices, regardless of carrier and manufacturer, and is currently utilized in MacroSolve's rapid mobile app development platforms. MacroSolve's patent covers fundamental technology in the mobile application space utilized by multiple companies.
MacroSolve's lawsuit claims that, "Hyatt, directly or through intermediaries, made, used, imported, provided, supplied, distributed, sold and/or offered for sale products and/or systems (including at least its product and system referred to as its Hyatt mobile app) that infringed one or more claims of the 816 patent. In addition, Hyatt induced infringement and/or contributed to the infringement of one or more of the claims of the 816 patent by its customers."

Judging by the January 2012 Investment Overview at http://www.illumemobile.com/wp-content/uploads/docs/011912_MCVE_SlideDeck_Website.pdf, this is by no means going to be the last lawsuit filed by MacroSolve. The company has been a pioneer in the app game through its patents and says that it has identified over 250 potential targets and intends to file 15 to 20 new suits every 60 to 90 days. A law firm is working at 100 percent contingent fee, so there is no cost to MacroSolve for enforcement.

The online travel booking company posted non-GAAP earnings of $512.6 million, or $9.95 a share, for the three months ended Sept. 30 on revenue of $1.45 billion, up more than 45% from the same period a year earlier. The average estimate of analysts polled by Thomson Reuters was for a profit of $9.30 a share on revenue of $1.42 billion in the latest quarter.

Shares rose 3.4% to $526.05.

Activision Blizzard reports third-quarter earnings after the close Tuesday. Analysts expect the game developer to earn 2 cents a share in the September-ended period on revenue of $558.4 million.

Activision on Tuesday released the latest Call of Duty title, Modern Warfare 3.

Shares were up 3.4% to $14.20.

Hewlett-Packard is looking to sell Palm's webOS mobile software platform, according to Reuters, which cited four sources close to the matter.

A sale of the unit could go for hundreds of millions of dollars but less than the $1.2 billion that HP paid last year, Reuters said.

Several technology companies -- including Amazon and Research In Motion -- have expressed an interest in buying the division, which is seen as attractive for its patents, the sources said.

The stock is up 50 cents to $28.02 in premarket trading Tuesday.

Dynegy's holding company filed for Chapter 11 bankruptcy protection.

Dynegy, the Houston-based energy company, filed for bankruptcy protection for Dynegy Holdings on Monday. Other Dynegy Holdings units also filed for bankruptcy protection. The parent company wasn't part of the filing.

The filing would lead to losses for bondholders, but wouldn't involve shareholders because the parent company isn't part of the filing, according to The Wall Street Journal.

Shares are down 5.4% to $2.79.

Toyota said fiscal second-quarter earnings fell 18.5% to 80.4 billion yen ($1 billion) as sales fell almost 5% because of parts shortages the company incurred from the earthquake and tsunami in March.

The company didn't give a forecast for the full year because of recent flooding in Thailand, which Japan's top automaker said has hurt production.

The stock fell 3.9% to $62.90 in premarket trading Tuesday.

Reporting earnings Tuesday are Take-Two Interactive, Fossil and Scotts Miracle-Gro.

Cogo Group Inc.’s (NASDAQ:COGO) U.S.-listed shares fell 29% after Chinese maker of software used in consumer electronic products late Thursday projected third-quarter earnings below expectations.

Rubicon Technology Inc. shares (NASDAQ:RBCN) fell 13% a day after the maker of crystalline products projected third-quarter earnings below expectations.
